Terms of Service

These Terms of Service ("Terms") govern your use of the BillSense mobile application and related services (collectively, the "Service") provided by BillSense ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. If you use the Service on behalf of a household, you represent that you are authorized to do so.

2. Account

You are responsible for maintaining the confidentiality of your login credentials and for any activity under your account. Notify us at support@billsense.app of any unauthorized use.

3. Subscriptions and billing

BillSense offers a free tier and a paid subscription ("Pro"). Pro subscriptions are billed in advance on a monthly or annual basis through your selected payment processor (Apple App Store, Google Play, or Stripe via RevenueCat). Subscriptions auto-renew at the end of each billing period unless cancelled before renewal. You may cancel at any time through your platform's subscription settings or through the in-app Customer Center.

Refunds are governed by the policy of the payment processor used at purchase. We do not control App Store or Google Play refund decisions. For Stripe-processed purchases, contact us within 14 days of charge for a refund of the most recent billing period.

4. Acceptable use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to access another user's account or data; (c) reverse engineer, decompile, or attempt to derive the source code of the Service; (d) use automated means to scrape or extract data from the Service; (e) interfere with or disrupt the Service.

5. User-provided data

The Service relies on data you enter (devices, usage, electricity rates) to estimate costs and identify potential savings. You are responsible for the accuracy of the data you provide. You retain ownership of your data and grant us a limited license to process it solely to operate and improve the Service.

6. Estimates are not guarantees

BillSense provides cost estimates, leak detections, and savings projections based on the data you input and statistical models. Actual energy consumption and savings will vary. We do not guarantee any specific monetary outcome and are not responsible for utility bills, equipment performance, or third-party rate changes.

7. Intellectual property

The Service, including its software, design, copy, and brand assets, is owned by BillSense and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service as intended.

8. Termination

You may delete your account at any time through the in-app settings. We may suspend or terminate your access if you violate these Terms or if continued operation would expose us to legal risk. Upon termination, your right to use the Service ends; we will retain or delete your data in accordance with our Privacy Policy.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the maximum extent permitted by law, BillSense and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of your use of the Service. Our aggregate liability for any claim shall not exceed the greater of (a) the amount you paid us in the twelve months before the claim, or (b) USD 50.

11. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which BillSense is registered, without regard to conflict-of-laws principles. Disputes shall be resolved in the courts of that jurisdiction unless your local consumer protection laws require otherwise.
